Help Please.. Considering Only One Spouse Filing Bankruptcy
I sure would appreciate some wisdom on this issue. I saw a lawyer for the free consultation, and he told me this could be done, but I am scared. How does a bankruptcy look at joint property, as far as listing assets? I am in deep with CC debt, most of it in my name only. Please if anyone has anything to share that would help me. If you have been through this I am sure you already know what is going on in my mind.

There is no requirement (except, perhaps, in community property states) that both spouses file for bankruptcy. Jointly held property as a married couple is generally subject only to joint debts. I'm unfamiliar with the NH exemptions. I strongly recommend speaking with a local bankruptcy attorney. He or she can look at your specific situation and let you know what you can and can't do.
