Auto Lease Reaffirmation
I Just filed for bk7 last week. I have a 36 month lease. I have paid on time for 29 months. Now because of the filing they will be unable to send me a monthly statement. Should I wait to hear from them or should I call them and let them know I want to continue with my "always on time" payments for the remaining 7 months? Or is it best to wait and see what they do?
Answer:
Different states have different ways of dealing with leases in bankruptcy. I strongly recommend asking your attorney how best to deal with this issue. (FWIW, here in MD and DC, you'd simply keep making payments.) Here in PA it's exactly the same way, just call and ask for their billing address... then write your check as normal but MAKE SURE you put account number in memo line, and you're good to go! If you want to keep "current" with your landlord, you need to make the payment on time without the monthly statement from your landlord. You are correct that during a BK, your landloard cannot send you bills any more. If you wait and see what your landlord will do without paying them, you are asking to be evicted. You need to keep the communication open with your landlord.
