Should I File For Ch. 7?
Hello...Let me explain a little of my situation to you and maybe someone can get back to me. I am 24, I live in CA, and I have about 18163.43 dollars in past due credit card debt that has long since been sold to bill collectors. I am enrolled in The Debt Solution..but I feel my payments are too high (387.00 a month) and I am not able to make it through the month without running out of money. I would like to settle my debt now instead of 2 years so I can move out and live on my own. Ive already been in the program since 12/2001 and they have only settled 4067.80 of my debt (i originally had 22231.23) and they have about 2,284.58 of my money in a bank account. Is it in my best interest to stay with them or to file for ch. 7 bankruptcy?
Answer:
Chapter 7 might possibly be in your best interest, but anyone advising you would need more information, such as what assets you own, what is your salary, and so forth. Many bankruptcy lawyers will give you a free consultation. One thing I usually tell people is that bankrputcy should not be treated as a first resort- try the alternatives first, which you have. It's impossible to say without a detailed evaluation of your situation by a bankruptcy attorney. I strongly rwcommend that you speak with someone.
