I have a few questions for those who know about it. Can file bankruptcy?: 1 An overstayed alien with good credit history whom work permit expired and keep using credit cards after permit expired? 2 A legal US or resident citizen in a foreign country? 3 A legal US or resident citizen in the military service in a foreign country? 4 A person who used cash advances only? 5 A person who purchased luxury items only? 6 A married person who doesn't know where his (her) spouse is? I've been through this site looking for some information to help me to understand differences between bankruptcy 13 and CCC, but in the process I got curious about questions above. Thanks. PS By the way. Answer:
All of the above can file for bankruptcy (and I have filed for everyone in this group). Yes, the alien can file. He/she can be held in connection with the immigration issues, but not for using the credit cards (under most circumstances).
