Who's To Blame?
I have had to file 2 different chapter 7s in the past 12 years, and now am considering filing a 13 since it has only been 4 years since the last 7 was filed. I see no way out of this viscous cycle I'm in, because I only have the equivelant of an 8th grade education.( My parents took me out of publiic school at age 14 because someone told them that public schools were evil.) I was not offered a choice, and feel my parents are to blame for my situation being the way it is. Can one sue their parents for being negligent in not providing a proper education for their children to make sure the child can grow up and be able to make a decent living? If I could get $60,000 from them and get a degree, I think I could stay out of bankruptcy court. Do you think it would work? Thanks in advance.
Answer:
Stop feeling sorry for yourself. You're not the victim of "negligent" parents. Many people with a lesser education have made more for themselves. Make up your mind to succeed and do well, and then start doing things to get to that goal. A windfall of $60,000 will not alter the cycle you are in. Three BKs in 15 years is a symptom of a problem. This problem won't change no matter how many BKs you do, or how much money you earn. Learning money management should be your first priority. Save your $185 filing fee and buy some books that teach you these valuable skills. Many people do not learn these in school. You will be better off than many who graduated from high school. Seems like a silly question and my guess is that you are not posting this as a serious question. But, assuming the best and that this is a serious post, I have two comments. The first is that, based on your writing ability, you obviously have more than "the equivalent of an 8th grade education". The second is that, since you are obviously well past the age of majority, the statute of limitations has long since run out on any claim of negligence or other harm that you might have suffered as a minor.
