One More Question--I Hope!

Question:
OK, pulled my credit reports; received 2 of 3 so far. I have found at least 2 creditors not even mentioning our bankruptcies (13 on 11/01 converted to 7 1/03 and discharged 4/03) and listing accounts as charge off or bad debts. I will contact them/the credit bureau and advised them to fix this. Here is my question. As some may remember, we had a bad 3rd mortgage (they say it's an equity line of credit, but that is BS) for $36000 that was to be stripped down in the BK 13. Then we converted to a 7, giving up the house in the process. Mortgage holder #1 is aware and starting foreclosure steps very soon. Ditto #2. House is way upside down as far as equity. The stripped down mortgage lender has not only not contacted us about anything, but is reporting the over $34000 on our credit reports as OPEN 120 Days Late, Amount due $34,437. My question: In the BK 7, what now is the position of lender #3, and should they be reporting this account as noted above on the credit report? They (or their representative, actually) have been notified so there is no excuse. Since this is no longer a Chap. 13, what exactly happens to a mortgage that was OK'd to be stripped down? I really need to know because I anticipate even further trouble with this company; they are reporting credit cards discharged in the BK as in Collections. Hope this post wasn't too confusing. Sorry to be a pest. Wish all of you well and hang in there. It does truly get better.

Answer:
Pull your credit report and dispute all of the accounts that have the "included in bankruptcy" as "not mine." you may get lucky and when the credit reporting agency tries to verify it, the creditor may not respond within 30 days. if they don't, it gets taken off the report. It is improper to lie to the credit agencies to try to remove a truthful report.
