Chapter 13 Question
Would anyone be able to tell me if you can just walk away from a chapter 13 early? I want to just stop paying and let the house go back to the bank. I'm guessing I still have to pay some attorney fees and I would like to see if I can keep my car. They crammed down the loan on that though so I don't know how that works. My attorney said I could just walk away but I cant get a hold of him right now.
You have the right to dismiss your Chapter 13 case at any time. Please note that some states allow a mortgage company to go after you for any shortfall resulting from the foreclosure. You might want to look at the possibility of converting your case to a Chapter 7 to avoid this. Speak with your attorney for more details.
