Time Period To File A Second Ch. 7???
Let's say I filed a CH.7 case back in December. We are in the process of trying to get that dismissed w/o prejudice. If that is successful, what is the time frame in which you have to wait in order to re-file a Ch. 7? I think I have read that it is 180 days. Does the time frame start as of your original filing date or does it start on the date the case is dismissed? In my case, Could I re-file in June or, since the case isn't dismissed yet, do I have to wait until I get the actual dismissal date and start counting down from 180 on that day?
If the case is dismissed without prejudice, you can file a new case the day after the dismissal. If it is dismissed with prejudice, you must normally wait 180 days from the date of dismissal before you refile. Why would you want to dismiss and refile a Chapter 7?
