How is garnishment calculate? What is the process the creditor has to follow in order to garnish my wages.
Generally, you must be sued, served with court papers, had a judgment entered against you, had a garnishment filed with the court, and had your employer served before the garnishment can go into effect. The procedure varies from state to state, as does the percentage that can be taken out of your paycheck. Speak with a local lawyer for more details. Curious...how is garnishment calculated if you are able to freelance? I've had no luck in finding a full time job in over a year so I might have to freelance to try to pay the bills (no savings left). How are wages calculated for a freelancer if you go month by month, some months making more, some months making less, some not making anything at all?
