MBNA Is Becoming A Pain In The Butt
my bankruptcy was discharged feb 4. But mbna kept calling since my 341 meeting, I was screening my calls bigtime(mainly communicating through cell phone) but I decided to talk to her, basically told her that she is trying to collect on a discharged debt, and she swore up and down that they were not aware of my bankruptcy and she would look into it. quite franky mbna was the only company I expected to file an objection because of the cash advances I took about three months before filing(4ks).Folks is it possible for a company to get a chapter 7 open again? and if they do what can I expect? Any input will be greatly appreciated.
Answer:
MBNA's obligation, if it was listed on your schedules, was discharged, and its calls are a clear violation of the discharge stay. Speak with your attorney; he or she can tell you how best to proceed.
