Need To Amend For Collection Agency I Left Off?
I filed my BK and had my meeting last month. I just ran my credit report and saw that there is a collection agency which I have never heard from and so didnt know existed. I did not include them in my original filing, but DID include the account that they are collecting for. Do I need to do an ammendment to incl this collection agency? One more thing, I tried to contact them via several means, including calling the original creditor whom they are collecting for, and they appear to have gone out of business. p.s. yes, I know Im stupid for not running all 3 of my credit reports before filing. Thanks for any help.

I recommend filing the amendment. Amending the pleadings to add a collection agent that is no longer in business seems beyond the scope of any debtor's duties. If you listed the original creditor don't worry about filing an amendment. Or, if you want to be sure about this issue, call the chapter 7 trustee assigned to your case and ask for her opinion. I'd bet she tells you to forget about it.
