Hi all, I'd like to run my situation by you'll and see what you think if anyone cares to comment t.i.a. I'm 62yrs old and on SSDI. I had an inheritance of considerable, but health problems medical bills ate it up. I got 30k in unsecured CC debt and only the SSDI for income now soo obviously I'm in deep doo doo! I got an old house thats paid for an a car thats not. I was going to file cp7 bankruptcy my brother got me in touch with his atty. His advice was "you don't need bankruptcy" your creditors can't garnishee your SSDI and your house is protected. Other assets must be valued at 3K to be up for grabs by the creditors... He says just write each creditor and tell them the situation that I can no longer make payments also to please not harass me with phone calls. I said to him_ but..30K! thats alot! he said 30K or 3K theres nothing they can take, they will likely turn some of the debt over to a collection agency but they can't get what you haven't got. I can see them making life very miserable just the same... oh and he did say call me if they sue you...hmmm what would you'all do? regards,

What I often tell clients in such situations is that if you want the worry *over*, file for bankruptcy. That puts a quick and legal end to it. If you don't mind the calls and can put aside the worry about the situation, then the lawyer's advice makes sense. Most people can't, however.
