Filed Chapter And Forgot Some Creditors ????

Question:
I filed chapter 7 but then realized I forgot to mention an o/s bill of AT&T now with collections agency for $220.00 and I also owe sprint $600.00. what do I need to do, keep quiet or ammend my filing and spend the extra cash. I am in NC

Answer:
If I were you--amend the filing and have them added on. They apparently are unsecured creditors and you need to have them listed in order for them to be discharged. Just explain that you were trying your best to remember everyone and somehow they slipped your mind. Most people who file are very nervous anyway trying to remember every little thing. Lots of people forget some creditors; it's hard to remember them all. One popped up on us (although we are disputing whether it is secured or unsecured) and was just added to the list. You need to be as honest as possible. Do you have a lawyer? If so, it's a lot easier for he/she to help you in situations like this then if you are just doing it yourself. Lawyers act as "middlemen" between the filer and the court, while relieves the filer of a lot of worry. Remember, if all goes well, even those debts you mention will hopefully be discharged in the bankruptcy. I really don't know what would happen to them (or you) if you don't report them. Of course, they will still demand payment and will do all they can to collect what's due them. Most eventually send uncollected debts to a collection agency, and they can be real pains in the ****. Amending is the easiest way to deal with it. The amendment fee for the Court is $20.
