Q: Anyone Know Repossession Law in NY?? Is it legal to repossess a car in NY without a Judgement? Is Cross-collateralization Legal in NY? My car was repossess based on late payment on a credit card with my credit union which is in California. I've searched high and low on this internet, but can't find anything specific about NY Law here on the web.

A: Usually, No; but, sometimes, Yes . . . . depending on lotsa facts you don't say about the nature/specific-content of the relevant parties' agreements, about who is/isn't the "owner" and the nature of the "possession" as defined by the agreements (regardless who, actually, possessed the vehicle at a particular time), about who the parties are (including, of course, business-corporate or invidiual consumer), including, since . . . Unless you have an identical twin or clone with the same problem, haven't you posted this question? and previously been told, correctly, that you need to be clearly about the above-indicated omitted lotsafacts before you will be able correctly to analyze your obligations/rights in the circumstances? you more clearly/specifically analyze the FACTS -- in particular, what, exactly, the various agreements to which you refer actually provide (perhaps *especially* since, as you note, you are dealing with a problem which appears to involve possibly applicable [and, if so, in part conflicting?] law of two states to the extent where you made the agreements and your residence [which you also don't mention] will inform their respective degree of controlling force) and, as well, the cost-vs.-benefit Thing [the probable value of the repossessed vehicle vs. your debt vs. who is/isn't likely to have to pay lawyers' fees to try to achieve whatever it is you want to achieve]).
