Recommnedation On Immigration Attorney Chicago???

Q: Could you recommend an immigration attorney at Chicago area. I am H1B holder and will be getting married to US citizen. So, need some help with filing related paperwork. I have been told that once we got officially married, my employment is no longer has to be H1B dependent. Can someone to confirm this. Appreciate all your inputs.

A: Frankly, unless there is some complicating factor in your case, you can probably file this adjustment of status yourself. Once you are married, you will need to file I-130, I-485, G-325A's (one for each of you), I-864, and for work authorization I-765. Bear in mind, after you file adjustment of status, you will have to also file I-131 for advance parole if you desire to travel outside of the US, as traveling without advance parole after filing AOS would cause the INS to consider your adjustment abandoned...be sure to have advance parole prior to traveling outside the US after you file AOS!! I would note that if you and your wife have been residing in the same household for a minimum of 6 months prior to filing AOS, YOUR income can also be counted toward meeting the requirements for the I-864 affidavit of support. You would file I-864A for your income and I-864 for hers, as she is the primary sponsor. Because of this, you may want to consider waiting for 6 months after marriage before filing AOS, in order to have your income also counted toward the affidavit. There is no requirement that you file AOS immediately after marriage unless you want to do so for some specific reason, by the way. However, until you obtain the EAD card from filing AOS based on the marriage, you will be obligated to work for the employer on your H1B. As soon as you get the EAD card from filing AOS, you can work anywhere you want.
