Iso Recommendation For Literary Attorney???
Q: I am seeking recommendations for a Literary Attorney. I am hoping to find the following: 1. Someone in or about the New York area. I travel to New York often, and would like to be able to meet the attorney occasionally. Plus, I think the NY attorneys are closer to the action. I am open to suggestions for attorneys from other locales, however. 2. I have several publishers interested in my non-fiction book. I'm a first-time author, and don't expect to get a triple-A contract. However, I think it is fair to expect the following: If the book does not sell all that well, the publishing house gets most of the money to cover their costs and give them some profit. In the unlikely but conceivable case that the book becomes very successful in its field, my renumeration should be progressively better as sales increase. I want an attorney who can confidently and forcefully negotiate such royalty terms, which are fair to both the publisher and myself. There are also issues of a related Web page and some other IP which need to be negotiated on terms that are reasonably fair to me as well as the publisher. 3. I am not rich. I can't afford $300 or $400 per hour. I'd say $250/hour is my upper limit. $150 to $200 per hour is better (much better). I'm not a famous movie star or politician, so I don't need the most well-connected power attorney, nor someone with 25 years in the field. A younger attorney, still establishing himself (or herself), but who can lend moral as well as legal support to my contract requirements, will do fine.
A: I'm not from NY, and a NY literary attorney might except, but your matter does not seem to me to REQUIRE the services of a lawyer... at least not for the bulk of it. Have you considered a Literary Agent as an alternative? Certainly you will need to consult a lawyer at some point, reviewing agreements, drafting for particular terms, and (esp for a first time author) certainly before you agree to or sign anything.... again BEFORE you sign anything... (including a literary agency agreement) but mostly a literary agent should be able to do most of the things you mention. May I suggest you Google.com search using the phrase "Literary Agent". This site looked promising, take a look http://www.pw.org/info.htm It may be you have already decided it was best to go ahead and use an attorney, that's your call. I simply mention the alternative.
