One of the recommendations of the AZ legislative study committee was: "Prohibit a HOA from placing a lien on property w/o a judicial determination that the lien and components thereof are valid and proper. Does not apply to liens arising from non-payment of assessments." I don't believe this will make the final cut for any proposed legislation. First of all, any penalties imposed upon an h/o are automatically tacked on to the assessments due; therefore non-payment is generally considered a delinquent assessment. Secondly, and most importantly, a non-judicial foreclosure of a home/unit in an HOA is currently against the law in AZ .
