Withholding Sexual Harassment Information

Q: Sexual harassment has definately occured, but the victim has not yet filed a complaint. If that person confides in another co-worker and seeks help from that person, is it illegal for them to NOT notify the employer or EEOC?

A:It is not illegal to not tell an employer about the sexual harassment, but it may be a violation of company policy. By contrast, if a witness is asked by the EEOC as part of its investigation of a sexual harassment claim if the harassment occurred and the individual lies about it, that could present a case of perjury.
