An Employee (male) Made A Sexual Harrasment Claim Against A Co-worker?

Q: An employee (male) made a sexual harrasment claim against a co-worker? (female). After HR investigated he admitted he was just trying to get even because she refused his advances. Now he has filed a complaint with the EEOC. Can you fire the liar?

A: At will employment means either party can terminate the relationship at any time for any reason. However, if he is terminated now, it will appear it is backlash for the EEOC complaint. I would imagine it is better to wait until the investigation is completed. It is probably best to speak directly with an attorney, though, as the company could be placed in a very precarious situation.
