In Their Dealings With You?
Q: I've been dealing with Harris & Dial for 2 years now. I paid them what I thought was fair... interest and charges included. On the check it stated settlement agreement and they cashed it. They took me to court in 2004 and the courts closed the case. This past fall they kept calling my parents so I got the number and phoned them to settle this looming annoyance once and for all. I've requested proof of the debt (by law they have to provide it) and they replied they don't have to supply that. Then said okay fax us a request, which I did and still have yet to receive proof. The guy I spoke to pretty much called me a liar after telling him the company cashed my check as far as I'm concerned this issue is resolved. He yelled at me saying they would never cash a check if in fact it was not an agreement. I faxed him the canceled check. They continuously call me and I tell them over and over take me to court AGAIN. They claim they've sent me 15 letters... funny I have yet to receive one! Last Thursday (June 22nd, 2006) Manny called from the company and when I told him that even if I was willing to pay (which I'm not) I don't work because I take care of my son he replied... "Oh, so you don't do anything all day". I replied I take care of my son and he replied with the same comment. Then he questioned how do I pay for my car and credit cards on my credit report if I don't do anything. He then continued to call me a dead beat and don't pay my bills... which I replied, clearly you can see that my bills are paid for, your just mad that your not one of them. He continued to talk over me by calling me a dead beat. Finally I told him like I've been saying... take me to court! He then said, you know I'll just run your credit report every 6 months. That was the last straw! I told him to never call me again and that I would be seeking an order of harassment against his company. Since then I have done the following: Research... discovered the AG sued them in 2004 (see info about it below) Per legal advise... sent them a letter demanding to cease & desist the harassing calls and every call I receive I will charge their company $150.00 Got a trial date to go to court again (funny they claim to have tried but were unsuccessful... hmmm wonder why) Filed a complaint with the Attorney General's Office Spoke to the Oversee'ers of the Bar Association.
