Action?
Q: I have been taken to court for release of automatic stay by a mortgage company. An agreement was made that allows foreclosure for future defaults. My question is If I default again must they file a court action? Or do they simply knock on my door?
A: It depends on which state you live in, and the terms of the consent order. Generally, the creditor must readvertise and reauction the property.
