South Florida Personal Injury Lawyers

Q: I saw a story in the newspaper last night that personal injury lawyers from the Miami area have been flying around the Caribbean signing up families of the crew of the FANTONE in a lawsuit against the owner. IMHO the captain, by all accounts an experienced sailor, did what he thought was best for his ship. Riding out a storm at sea generally results in less damage in the long run, if the ship is secured and the crew prepared. Unfortunately, the FANTONE ran up against a killer storm and sunk with the loss of all hands. I find these lawsuits distressing. I can picture the lawyer in court, weeping families behind him, ripping into the greedy corporation and venal captain more concerned with their valuable asset than with the lives of the crew. While I grieve for the loss of a valiant crew and a majestic ship, the hazards of the sea will always be with us. The FANTONE

was stout and sound, had sensibly discharged all of her passengers, and was ably commanded. What do you think about this????

A: On a related note, also IMHO, the litigious nature of our society is making accident investigation more difficult. Where is the incentive for those involved to give true and honest accounts of any mistake or equipment failure when there are lawyers waiting to seize upon the slightest hint of non-perfection to file suit? I am in complete agreement with your points on lawyers second guessing mariners once the hurricane is gone. One small correction is that the ship was the Fantome (French for Phantom.)
