Obtaining Permanent Residence After Getting Divorced???
Q: I have searched through most of the posts in this group before creating a new forum myself, but I couldn't really find what I was looking for. My case is as follows: I have been married to a USC for two years, then separated for one more year. We are currently divorced. We have applied for Removal of Conditions (I-751) together, in Sept. '04, at the Vermount service center. We have been called for an interview in July '05, but since we were already separated and I was living in NJ, my case has been moved in Jersey. (Just to make it clear, the immigration people decided that we shouldn't show up to the i-view, they have just sent my case to Jersey.) I have never received a letter from Jersey ever since. In the meantime, we have got divorced, and as far as I know, I have to apply for a waiver (re-submit I-751 by myself this time). Why am I here? I have seen SEVERAL immigration lawyers, but honestly there was no-one that I could trust. I am looking for real advice from real people that have been through similar situations, please. I would appreciate any referral to very good immigration lawyers. (Please don't just spam my topic with any lawyers that you just want to advertise for free!) I am looking for a good lawyer in NYC, someone with plenty of experience, who is ready to get the things moving, who knows what he's doing, and MOST IMPORTANT: who will pick up the phone when I am calling to check my case! (I am sick of lawyers that will just keep me waiting for hours, etc.) Also, if there are people that have been in similar cases, could you please answer my question: 1. Do you think that I can apply by myself now, or do I really need a lawyer to do it?
A: -I don't think there's any trick to this... resubmitting the I-751, I mean. You need to demonstrate that the marriage was entered into in good faith! Now... that said, a laywer may help you sleep better at night - but, perhaps more importantly, a lawyer will know
