Help Workers Comp,Personal Injury Attorney???

Q: I was wondering if a wife or ex-wife can sue a workers comp Insurance carrier? My husband has been on work comp for the last six years and has developed sever depression due to the insurance company's rights to play GOD in his life they refuse to admit he has an impairment even though his treating Phychiatrist has giving him an 80% rating and this is only an unscheduled injury the scheduled injury from his orthopedic Doctor has giving him a 20% rating. Never the less I have been his Nurse, Secretary, and Attorney and can no longer be strong for him due to the Actions and InActions of the Insurance comp.My husband used to be so outgoing and full of life and now has isolated himself from the world and his family.We are in the process of losing everything we own eventhough he still receive's TTD.Any help would be appreciated thank you.PS We do have a workmans comp attorney,but Im intrested in civil suit for myself and my five year old daughter.

if the insurance company has violated some basic rules in the process of a work comp claim a lawsuit can be filed for what's called Fraud and Abuse. Some states allow a direct action against the insurance company for Bad Faith. However, it sounds like the insurance company is just defending the claim which is not illegal in and of itself. Work Comp provides for very limited and specific benefits and will not provide anything just for the inconvenience and suffering the family will experience. Set up an appointment with your work comp attorney and find out what if any options you have. But you need to understand that the law doesn't provide a remedy for every problem.
