Free Immigration Attorney

Q: Could I win this case in court? I'm filing a small claim against my immigration attorney. I hired him in May 2006 and I paid $2300 ($1200 more would be added after they do everything needed) to help me with H1B visa related filings. I had everything ready but they filed my papers late and I missed the cap. He assured me that I can file for H2B, and signed a contract for free service, since he messed up. I could never get in touch with him, my visa was about to expire the end of December. He finally started working on my case after many requests on my side in November, the whole process is time consuming and there was no time to wait for him so I did all the filings myself. I explained them that I'm very unhappy about their negligence and I want my money back. They're hiding all the time and recently sent me a bill for $1200 that I won't pay since they did nothing, but they say they'll send me to Collection. I plan to file a small claim for $2300 but I don't know what are my chances. Anyone experienced help me???

A: get a lawyer

who is not an immigration lawyer. It is malpractice for them to improperly delay your findings and for them not be be availble for you to contact. you need to get another lawyer on this case. Why did you even hire a lawyer in the first place, you didn't need one to get citizenship as long as you can pass all their background checks, tests, interviews, etc. It may be hard to prove that there was any wrong doing. Hopefully, you kept all your records and documents. You are dealing with an attorney, and you will not win, unfortunatly. He is an inept one at best according to your notes. I wish you the best. Yes, collections will be after you for the balance whether or not you owe it.
