Q: A sexual harassment lawsuit, you settle. 1 conditions being not to disclose info. What happens if they do?
I know someone who had a sexual harassment lawsuit and settled for $75 K's. One of the conditions was not to disclose any information regardin this. What happens if they do? Do they have to re-pay the settlement? Do the get contempt of court order? I feel it is wrong to do so in accordance with the contractual agreement.....
A: The action taken if a violation of the contract occurs is negotiated on a case-by-case basis. Generally, they are required to pay back the amount plus interest, court cost, etc. Plus, there may be additional civil penalties the person may be subject to dependent upon the agreement. Some contracts such as this sometimes include a provision for awards to cover liable/slander.....all depends on the situation. No two are totally alike.
